				<content:encoded><![CDATA[<p>Mayor Fred Froehlich called the Public Hearing of a Conditional Use Permit request of Mike Mans, 821 Nicollet Avenue, Nicollet, MN. to order at 6:00 p.m. on April 22, 2013, in the council chambers. </p>
<p>In addition to Mayor Froehlich; Council members Steve Johnson, Tom Hoffman, Mary Wels and John Enter were in attendance.   Others in attendance included Vanessa Drill, Gary Johnson, Don Lannoye (<i>Schauer Law Office</i>), Mike Mans, Lyle &amp; Carol Wills, Lu Vern Giefer, Vicky Rudenick, Tom Rieke, Dean Wels, Robert Freitag, Chris Shay, Paul Zins, Sr., Kevin &amp; Barb Christenson and Michael Koob (<i>Ledger)</i>. </p>
<p>The purpose of the meeting was to hear comments of the permit request which was to allow a 52’ x 36’ garage to be built on the empty lot adjacent to Mr. Mans’s property.  The property is currently zoned as an R-1 (Single Family Residential).  Such use can be permitted in an R-1 Zone with conditions.  The request for conditional use was explained. </p>
<p>Mike Mans supplied a drawing to everyone that was present.  He explained that this will be on the north side of his property and garage will be used for storage purposes.  Mans stated that he will be merging the empty lot with his property at 821 Nicollet Ave, so that there will only be one lot. </p>
<p>1.  City Clerk<br />
* Read a letter from Dave Holcomb of 800 Nicollet Ave, expressing concerns of the size of the building, what other people may want to do with similar requests and what someone else might use the building for in the future when Mans no longer owns it</p>
<p>2.  LuVern Giefer<br />
*  Expressed in 20 years when Mans could possibly not own the property, we could have another junkyard in town, referencing the property at 904 8<sup>th</sup> Street</p>
<p>3.  Tom Rieke<br />
*  Expressed concern about “what’s gonna happen down the road”</p>
<p>4.  Paul Zins, Sr<br />
*  Stated the building that Man’s is proposing, looks first class and will be an improvement</p>
<p>5.  Robert Freitag<br />
*  Felt the structure was a little bit more than a garage.  Noted that it was nice looking and was a big as a machine shed on his family farm.  Concerned of the impace the structure might have on his property value</p>

*  Noted that the council can place any conditions on the permit they feel suitable </p>
<p>At 6:25 p.m. the public hearing was adjourned.  At 6:30 p.m. the Council turned its attention to the business of the April 22, 2013, regular meeting.  </p>
<p>Roll call was noted; Mayor Froehlich; Council members Steve Johnson, Tom Hoffman, Mary Wels and John Enter were in attendance.   Others in attendance included Vanessa Drill, Gary Johnson, Don Lannoye (<i>Schauer Law Office</i>), Mike Mans, Lyle &amp; Carol Wills, Lu Vern Giefer, Vicky Rudenick, Dean Wels, Chris Shay, Paul Zins, Sr., Del Vulcan, Ron Giefer,Jr., DuWayne Enter, Kathy Enter, Sietze Blankers, Nicolai Blankers, Michael Koob (<i>Ledger) and </i>Joe Duncan<i> (Bolton &amp; Menk).</i>     </p>
<p> <i>The agenda was approved on a motion which was made S. Johnson, which was seconded by M. Wels, and which carried with all voting in favor.</i><i> </i></p>
<p><i>The minutes of the April 1, 2013 regular meeting was approved on a motion which was made by S. Johnson, which was seconded by T. Hoffman, and which carried with all voting in favor.</i></p>
<p><i>The bills totaling $57,051.23 were approved on a motion which was made by J. Enter, which was seconded by T. Hoffman and which carried with all voting in favor.</i></p>
<p>Don Lannoye informed the council that they have 60 days from the application request for the conditional use permit to make a decision or such a use will be granted.<i> </i></p>
<p><i>A conditional use permit for Mike Mans, 821 Nicollet Avenue to construct a 52’ x 36’ garage on the adjacent lot to his property with the following conditions:<br />
</i><b><i>1.  The property must stay as one lot<br />
</i></b><b><i>2.  The building that is constructed must be used for storage purposes<br />
</i></b><b><i>3.  The material used to construct the building and the building itself must match the property owner&#8217;s house<br />
</i></b><b><i>4.  There must not be any unreasonable noise within the building<br />
</i></b><b><i>5.  The building cannot be rented out by the property owner<br />
</i></b><b><i>6.  The property owner must follow all current city ordinances in regards to parking vehicles<br />
</i></b><b><i>7.  The building that is being constructed cannot be used for business purposes and a business cannot be run </i></b><b><i>out of the building<br />
</i></b><i>was approved on a motion which was made by S. Johnson, which was seconded by M. Wels, and which carried with all voting in favor.</i> </p>
<p>Del Vulcan with the American Legion requested use of the city building for Friendship Days.  S. Johnson noted that they will go with the recommendation of the Maintenance Supervisor what can be used and not used during this time. </p>
<p>DuWayne Enter, Ron Giefer, Jr and Sietze Blankers were present to discuss the sewer extension agreement that they received from the City.  The agreement was approved in 2008 but never signed.  The agreement grants to the City a perpetual easement for servicing, maintenance, repair and replacement of a sanitary sewer service line and grinder pump and that the property owner will be responsible for the entire cost of all repair, maintenance and replacement of the grinder. </p>
<p>It was noted that the 5 sewer grinder pumps failed.  D Enter stated that he will not sign the agreement since he believes that they were incorrectly installed.  Joe Duncan noted that Bolton &amp; Menk were onsite during the installation of the pumps to make sure the system was installed according to specifications. </p>
<p>The council agreed to get an estimate to install a check valve on each of the pumps and to have each pump inspected so the property owners know the condition of the pumps prior to taking over financial responsibility. </p>
<p>The Clerk informed the council that the property at 731 3<sup>rd</sup> Street has not signed a letter agreeing to clean-up his garage by May 1, 2013.  Froehlich noted that he will follow-up with the property owner. </p>
<p>Froehlich noted he has received several complaints about the property at 500 3<sup>rd</sup> Street, Robert Albrecht regarding many vehicles parked on the property.  He noted that the property is being taxed as a residential property even though it is in a commercial zone.  Don Lannoye will look into the ordinance and send a recommendation to the council regarding an amendment to address commercial properties and parking of junk vehicles.</p>
<p>The Clerk:<br />
1)  Noted a street dance request on June 1 in the 200 block of Pine Street.  The dance is for a fund raiser for breast cancer.  Council agreed if all the neighbors of that block were notified and that cleanup was done by the party requesting that the request is granted<br />
2)  Reported that in order for Xcel Energy to estimate how much it would cost to bury some lines on Highway 111 and 99,  Xcel Energy would need an “engineer’s estimate down payment” of $5000 in order to estimate the work </p>
<p>Maintenance Supervisor supplied a water movement report and noted that wood chipping will begin on Monday, May 6.  Wood chipping is the on the 1<sup>st</sup> &amp; 3<sup>rd</sup> Monday’s at 3:00 p.m. to 6:30 p.m. </p>
<p>Joe Duncan presented a tabulation of the bids which had been received for the 2013 Street and Utility Improvements projects.  Duncan recommended that the Council accept the bid of MR Paving &amp; Excavating, in the amount of $1,408,781.40.  Said bid is lower than the engineer’s estimate of $1,457,285.75. </p>
<p><i>RESOLUTION 04-22-13: Receiving Bids and Awarding Contract on the 2013 Street and Utility Improvements</i><i>, was approved on a motion which was made by S. Johnson, and which was seconded by M. Wels and which carried with all voting in favor.</i><i> </i></p>
<p>The council considered a resolution that would increase the water and sewer rates by five percent a recommendation that came off of the 5 year plan.  After a discussion the resolution wasn’t voted on and the council instructed the clerk to create a different resolution that would show a water rate increase of 5 percent and a sewer rate increase of 2 percent.  The clerk will present the resolution at the next regular meeting. </p>
<p><i>The following building permits were approved on a motion which was made by T. Hoffman, and which was seconded by J. Enter and which carried with all voting in favor:<br />

<p>At 8:45 the council had a closed meeting.  The closed meeting was to discuss the purchase of the property at 500 Main Street for the 2013 Street &amp; Utility Improvements. </p>

				<content:encoded><![CDATA[<p>Mayor Fred Froehlich called the meeting of the Board of Appeal and Equalization to order at 6:00 p.m. on April 1, 2013, in the council chambers. </p>
<p>In addition to Mayor Froehlich; Council members Tom Hoffman, Mary Wels and John Enter were in attendance.   Councilman Steve Johnson was absent.  Others in attendance included Vanessa Drill, Vicki Hagen and Mark Carlson (<i>Nicollet Co. Assessor’s Office</i>), Michael Koob (<i>Ledger)</i>. </p>
<p>The purpose of the meeting was to hear comments on valuations of various properties in the city.  No appointments were made and no residents attended. </p>
<p><i>At 6:30 p.m. Board of Appeals and Equalization meeting was adjourned, which was approved on a motion made by T. Hoffman, which was seconded by J. Enter, and which carried with all voting in favor.</i> </p>
<p>The Council turned its attention to the business of the April 1, 2013, regular meeting.  The following roll call was noted; Mayor Froehlich; Council members Steve Johnson, Tom Hoffman, Mary Wels and Johns Enter.  Others in attendance included: Vanessa Drill, Darin Drill, Kyle Meyers (<i>Abdo, Eick and Meyers</i>) and Michael Koob (<i>Ledger)</i>. </p>

<p><i>The agenda was approved on a motion which was made J. Enter, which was seconded by M. Wels, and which carried with all voting in favor.</i><i> </i></p>
<p><i>The minutes of the March 11, 2013 regular meeting was approved on a motion which was made by M. Wels, which was seconded by T. Hoffman, and which carried with all voting in favor.</i> </p>
<p><i>The bills totaling $44,970.14 were approved on a motion which was made by T. Hoffman, which was seconded by J. Enter and which carried with all voting in favor.</i><i> </i></p>
<p>The Clerk shared that Mike Mans applied for a conditional use permit to construct a 52’ x 36’ garage for private storage on the empty lot adjacent to his property on Nicollet Avenue.  The property is currently zoned as an R-1 (Single Family Residential).  Such use can be permitted in an R-1 Zone with conditions.  Council discussed possible scenarios and instructed the Clerk to notify Mans that there is a strong possibility that the request may be denied. </p>
<p>Maintenance employee Darin Drill noted that he will be attending Wastewater School April 9-11. </p>
<p>D. Drill also noted that the maintenance department would like to purchase a Wacker Centrifugal Trash Pump to manage inflow to the sewer ponds. </p>
<p><i>Permission for the Maintenance Department to purchase a Wacker Centrifugal Trash Pump in the amount of $4,225 was approved on a motion which was made by S. Johnson, which was seconded by M. Wels, and which carried with all voting in favor.</i><i> </i></p>
<p>It was noted that the owner of the property on Walnut Street is responsible for the cost of repairs for a recent break in the water line that serves the property per City Policy. </p>
<p>Mayor Froehlich summarized his attendance at the Highway 14 meetings. </p>
<p>Councilman Hoffman noted that at his meeting with Minnesota Council of Governments that NIMS training maybe offered for the local officials and staff. </p>
<p>Kyle Meyers (Abdo, Eick, &amp; Meyers) presented the 2012 Audit report. </p>
<p><i>The 2012 Audit Report was accepted on a motion which was made by T. Hoffman, which was seconded by J. Enter, and which carried with all voting in favor.</i><i> </i></p>
<p><i>Application Payment No. 6 to Colway Contracting in the amount of $1,804.28 was approved on a motion which was made by J. Enter, which was seconded by S. Johnson, and which carried with all voting in favor.</i><i> </i></p>

				<content:encoded><![CDATA[<p>Prior to the March 11, 2013 meeting being called to order, the clerk administered the Oath of Office to the re-elected Councilmember, Steven Johnson.  </p>
<p>Mayor Fred Froehlich called the regular March meeting of the Nicollet City Council to order at 6:30 p.m., in the Council Chambers.  </p>
<p>In addition to Mayor Froehlich; Council members Steve Johnson, Tom Hoffman, Mary Wels and John Enter were in attendance.  Others in attendance included; Vanessa Drill, Gary Johnson, Darin Drill, Adam Reichel, Amy Ruch, DuWayne Enter, Kathy Enter, Ron Giefer, Jr. and Michael Koob (<i>Ledger</i>). </p>
<p><i>The agenda was approved on a motion which was made M. Wels, which was seconded by J. Enter, and which carried with all voting in favor.</i><i> </i></p>
<p><i>The minutes of the February 19, 2013 regular meeting was approved on a motion which was made by M. Wels, which was seconded by J. Enter, and which carried with all voting in favor.</i> </p>
<p><i>The bills totaling $40,530.66 were approved on a motion which was made by S. Johnson, which was seconded by T. Hoffman and which carried with all voting in favor.</i><i> </i></p>
<p>The Clerk:<br />
1)  Noted the 2012 Audit Review will be on April 1<br />
2)  Stated that since the City didn’t get the grant for the emergency siren, Firechief Polzin found a company that could make the current siren compatible with the new 800 MHz radio system for a cost of $2,100 </p>
<p>The Maintenance Supervisor:<br />
1)  Supplied a water movement report<br />
2)  Supplied a quote for a street sweeper<br />
3)  Stated the maintenance department sold a pump and generator and would like the monies to go toward the purchase of a new pump to be used to pump excess water </p>
<p><i>A quote to purchase a 2001 Elgin Pelican P Single street sweeper from MacQueen Equipment in the amount of $31,250 was approved on a motion which was made by S. Johnson, which was seconded by M. Wels, and which carried with all voting in favor.</i><i> </i></p>
<p>Adam Reichel and Amy Ruch, residents of the property located at 500 4<sup>th</sup> Street asked the council for a letter that will help them refinance their property.  The property at address 500 4<sup>th</sup> Street, Nicollet, MN is zoned in a commercial zone.  If this home is destroyed by any cause to an extent exceeding 50 percent of its fair market value as indicated by the records of the county assessor, a future structure or use on the site shall conform to the Land Use Ordinance No.79.  A single and multi-family dwelling is not a permitted use in a commercial zone. </p>
<p><i>For the property address 500 4<sup>th</sup> Street, the current council would approve the use of a single and mutli-family dwelling on the site pending the outcome of a conditional use hearing, said motion was approved by T. Hoffman, which was seconded by M. Wels, and carried with all voting in favor.</i>           </p>
<p>Ron Giefer, Jr, DuWayne Enter and Kathy Enter were present to discuss sewage issues on Birch Street.  Three homes on Birch Street have grinder pumps that grind up the waste and then push it into the city wastewater system.  They noted there are problems with the pumps and stated they never received an owner’s manual when the pumps were installed. <i> </i></p>
<p>Mayor Froehlich secured donations for a raised garden landscape project in front of City Hall.  He noted the following commitments;  Nicollet Chamber of Commerce &#8211; $1,500, Nicollet Conservation Club &#8211; $1,500 and Nicollet Lions Club &#8211; $500. </p>
<p><i>Bid from Cornerstone Landscape Contractors in the amount of $3,385 which includes a recognition boulder was approved on a motion by J. Enter, which was seconded by S. Johnson, and carried with all voting in favor</i>. </p>
<p>Froehlich shared a report from his attendance at the Fire Relief Meeting.  It was noted that the City as of February 28 will no longer have the snow removal contract for the Fire Hall.  The relief association accepted the bid from C.J. Yard Care &amp; Snow Removal. </p>
<p>Froehlich stated that George Poehler was concerned of flooding in George’s City Meats.  It was noted that Poehler has piles of snow in the backyard that are not allowing water to escape. </p>
<p><i>Application #5 for Colway Contracting &amp; Construction in the amount of $16,952.26 &#8211; $1,804.28 (work not inspected) = $15,147.98 was  approved on a motion made by T. Hoffman, which was seconded by M. Wels, and which carried with all voting in favor.</i><i> </i></p>
<p><i>A bid from Cleary Building Corp in the amount of $845.93 for the wrapping of doors in the front of City Hall (amount was not included in original bid) was approved on a motion made by M. Wels, which was seconded by J. Enter, and which carried with all voting in favor.</i><i> </i></p>
<p>The Council set Monday, May 13 @ 5:30 p.m. for their annual City Wide Tour.</p>
<p>The following council meetings were set:  April 22 @ 6:30 p.m., May 13 @ 6:30 p.m. and June 3 @ 6:30 p.m. </p>
<p>At 8:45 p.m. the Council closed the meeting to discuss employee reviews. </p>
<p><i>At 9:35 p.m. the Council reopened the meeting.  A 5.9 %  pay increase for Gary Johnson, Vanessa Drill and Darin Drill  was approved on a motion made by T. Hoffman, seconded by M. Wels, and carried with 4 votes in favor and 1 vote opposing.</i><i> </i></p>

				<content:encoded><![CDATA[<p>Mayor Fred Froehlich called the regular February meeting of the Nicollet City Council to order at 6:30 p.m., in the Council Chambers.  </p>
<p>In addition to Mayor Froehlich; Council members Tom Hoffman, Mary Wels and John Enter were in attendance.   Council member Steve Johnson was absent.  Others in attendance included; Vanessa Drill, Gary Johnson, Jeff Grommersch (<i>Community Insurance Agency</i>), Jason Femrite (<i>Bolton &amp; Menk</i>) and Michael Koob (<i>Ledger</i>). </p>
<p><i>The agenda was approved on a motion which was made T. Hoffman, which was seconded by J. Enter, and which carried with all voting in favor.</i><i> </i></p>
<p><i>The minutes of the January 28, 2013 regular meeting and special meeting on February 4, 2013 was approved on a motion which was made by M. Wels, which was seconded by T. Hoffman, and which carried with all voting in favor.</i> </p>
<p><i>The bills totaling $73,383.34 were approved on a motion which was made by T. Hoffman, which was seconded by M. Wels and which carried with all voting in favor.</i><i> </i></p>
<p>Jason Femrite with Bolton &amp; Menk presented the plans and specifications for the 2013 Street &amp; Utility Improvement Projects.  The bids will be opened on March 27 and construction can approximately begin on May 1.  Femrite stated before any contracts can be awarded an easement muse be secured for the Walnut Street utility project and a right of way must be obtained to widen 5<sup>th</sup> street near the intersection with Main Street.                                                                       </p>
<p><i>Resolution 02-19-13 Approving Plans and Specifications and Ordering Advertisement for Bids for the 2013 Street &amp; Utility Improvement Projects was approved on a motion which was made by T. Hoffman, which was seconded by M. Wels, and which carried with all voting in favor.</i> </p>
<p>Jeff Grommersch, Community Insurance Agency, provided the Council an overview of current City insurance and optional coverage’s.<i> </i></p>
<p><i>The City waives the statutory tort liability limits, which was approved on a motion made by J. Enter, which was seconded by M. Wels, and which carried with all voting in favor. </i><i> </i></p>
<p>The Board of Appeal and Equalization Hearing was set for Monday, April 1, 2013 at 6:00 p.m. prior to the regular council meeting. </p>
<p><i>A transfer of $175,000 out of the Sewer Fund into Water Fund to redistribute cash effective per the 5 Year Plan effective 12/31/2012 was approved on a motion made by M. Wels, which was seconded by T. Hoffman, and which carried with all voting in favor. </i><i> </i></p>
<p><i>A transfer of $45,900 out of the EDA Fund into the General Fund to payback debt owed to fund per the 5 Year Plan effective 12/31/2012 was approved on a motion made by J. Enter, which was seconded by T. Hoffman, and which carried with all voting in favor. </i><i> </i></p>
<p><i>A transfer of $75,000 from Money Market account into checking was approved on a motion made by T. Hoffman, which was seconded by M. Wels, and which carried with all voting in favor.</i> </p>
<p>The Maintenance Supervisor:<br />
1)  Supplied a water movement report<br />
2)  Reported the Maintenance department looked into a used street sweeper<br />
3)  Noted a water line break that services 4 homes, asked about who should be billed for repairs.<br />
4)  Stated the residents that live on Birch Street have never signed an agreement regarding the grinder pumps that they use that grind up the waste and push it into the city’s waste water system.<br />
5)  Stated that if city employees are going to maintain the water line and grinder pumps on Birch Street, the city needs a utility easement. </p>
<p>The Council directed the Clerk to contact the City Attorney regarding an agreement for the grinder pumps and utility easement for Birch Street residents.  Also, the Clerk was instructed to discuss with the attorney the options available to get Colway Construction to complete the addition to City Hall along with inquiring about an “after the fact” fee on zoning. </p>
<p>Mayor Froehlich stated that he is soliciting donations for a landscaping project for in front of City Hall. </p>
<p><i>The request from the Maintenance Department to purchase a self contained large rolling toolbox in the amount of $3,500 was approved on a motion made by J. Enter, which was seconded by M. Wels, and which carried with all voting in favor.</i> </p>
<p><i>Church of St. Paul 3.2 License and LG220 Application for permit for the annual festival 6/09/13 was approved on a motion which was made by M. Wels, which was seconded by J. Enter, and which carried with all voting in favor.</i><i> </i></p>

				<content:encoded><![CDATA[<p>Mayor Fred Froehlich called a special meeting of the Nicollet City Council to order at 6:30 pm on February 4, 2013, at City Hall. </p>
<p>In addition to Mayor Froehlich; Council members Mary Wels, John Enter and Tom Hoffman were in attendance.   Councilman Steve Johns was absent.  Others in attendance were: Vanessa Drill, Gary Johnson, Paul Honken, Dev Havemeier, Paul Zins, Sr., Jeff Holmin, Ryan Schmidt, Tim Bode, Bryan Bode, Dave Otto and Michael Koob (<i>Ledger</i>). </p>
<p>The purpose of this special meeting is to have a REAL ESTATE AUCTION on the property located at 205 Pine Street, Nicollet, MN </p>
<p>Mayor Froehlich noted that the siren on top of the building along with the white shed in the back will be moved in the spring when the weather is nice.  Also the bulk water pump in front of the building will stay where it is located as it is located in the boulevard portion of the city street. </p>
<p><i>The building was sold for $55,000 to Dave Otto on behalf of Travis Otto with the purchase agreement signed which was approved on a motion made by M. Wels, which was seconded by T. Hoffman and which carried with all voting in favor.</i><i> </i></p>

				<content:encoded><![CDATA[<p>Mayor Fred Froehlich called the Special Meeting to order at 6:00 p.m. on January 28, 2013, in the council chambers. </p>
<p>In addition to Mayor Froehlich; Council members Mary Wels and John Enter were in attendance.   Council members Steve Johnson and Tom Hoffman were absent.  Others in attendance included; Vanessa Drill, Patrick Kunerth, Mike Mans, Rick Hulke, Jeff Holmin and Michael Koob (<i>Ledger</i>). </p>
<p>The purpose of the public hearing is to consider an application of Patrick Kunerth /Abbot Storage Inc, Nicollet, MN for a conditional use permit.  The said permit is to allow Mr. Kunerth the ability to have an apartment located at 635 3<sup>rd</sup> Street, which is currently zoned as commercial.  Such a use of the property can only be permitted in a commercial zone with conditions. </p>
<p>At 6:35p.m. the special meeting was adjourned and the Council turned its attention t o the business of the January 28, 2013, regular meeting.  The following roll call was noted; Mayor Froehlich, Council members; Mary Wels and John Enter.  Council members; T Hoffman and S Johnson were absent.   Others in attendance included:  Michael Koob (<i>Ledger</i>).  Staff present:  Vanessa Drill and Gary Johnson.  </p>

<p><i>The bills totaling $97,010.29 were approved on a motion which was made by M. Wels, which was seconded by J. Enter and which carried with all voting in favor.</i><i> </i></p>
<p><i>Conditional Use Permit for Abbot Storage Corporation with said conditions (1) Owner will provide off street parking for tenants and will provide copy of the lease to council, Owner will be responsible for any towing of tenants vehicles if they are towed away for parking on the street 2)  Owner will only allow pets that won’t need to go outside to defecate, starting with the next tenants, owner will provide name of the tenants to the city) was approved on a motion which was made by J. Enter, which was seconded by M. Wels, and which carried with all voting in favor. </i> </p>
<p>The Clerk:<br />
1)  Stated that the city wasn’t approved for the grant for the Hazard Mitigation Assistance program thru MN Department of Public Safety for the new emergency siren.<br />
2)  Informed the council that Mike Mans was inquiring about the zoning for a 40&#215;50 shed in a residential area.<i> </i></p>
<p>The Maintenance Supervisor:<br />
1)  Stated that Paul Zins Sr. was removing snow/ice from Hopp Avenue and 4<sup>th</sup> Street on January 8, 2013, which is in violation of MN Statute which is punishable with a $400 fine.  The council instructed the Clerk to send a letter to Mr. Zins notifying him that he was in violation.<br />
2)  Provided Waterwater Pretreatment Annual Reports of the Significant Industrial Users which have been sent to the Minnesota Pollution Control Agency.</p>
<p><i>Election Judges for the SPECIAL Primary Election (January 29) and SPECIAL General Election (February 12) were approved on a motion which was made by J. Enter, which was seconded by M. Wels, and which carried with all voting yes.  Those approved are as follows:  Vanessa Drill (Head Election Judge), Jane Hermel, Betty Schmidt, Sharon Steffen, Pat Thompson and Mary Voeltz, Bridgette Kennedy (Nicollet Co. Auditor), and Christine Johnson (Deputy Nicollet Co. Auditor).</i><i> </i></p>

<p>The Clerk:<br />

3)  Stated a resident asked for relief on their sewer bill, the residents left the hose running in<br />
      their back yard and was asking for relief on sewer only.  Council noted that this hasn’t<br />
      been done in the past, so sewer relief will not be granted<br />
4)  Stated that there will be a newly and experienced elected officials conference<br />
      January 25 &amp; 26 in Mankato<br />
5)  Noted that there will be a Special Primary and General Election in January and February to<br />
      replace the State Representative seat vacated by Terry Morrow<br />
6)  Reported that 3 nuisance letters were sent out to residents.  Two of the residents have <br />
      complied, the other resident spoke with the Mayor about an extension until May 1,<br />
      the council stated this was fine if the resident puts that he will comply by May 1 in writing</p>
<p>The clerk noted that Patrick Kunerth responded to a city letter regarding obtaining a conditional use permit for an apartment in the commercial zone.  A public meeting will be scheduled for a conditional use hearing.</p>
<p>The Maintenance Supervisor:<br />
1)  Supplied a water movement reports<br />
2)  Stated maintenance employee Darin Drill will be going to water class in March to get his<br />
      Class B license<br />
3)  Stated that maintenance was done on the sewer pumps and shared pictures of what was <br />
      pulled out of the pumps</p>
<p>It was noted employee reviews will be done January 9 by Froehlich and Hoffman. </p>

<p><i>Application #4 for Colway Contracting &amp; Construction in the amount of $47,953.10 &#8211; $17,408.63 (retainage) = $30,544.47 was not approved for payment, until Colway Contracing can provide signed lien waivers stating that the subcontractors and their vendors have been paid to date was approved on a motion made by T. Hoffman, which was seconded by M. Wels, and which carried with all voting in favor.</i><i> </i></p>

				<content:encoded><![CDATA[<p>Mayor Glenn Thompson called the Truth in Taxation Hearing for the 2013 Budget and Tax Levy to order at 6:15 p.m. on December 3, 2012 in the Council Chambers. </p>
<p>In addition to Mayor Thompson; Councilmen: Steve Johnson, Fred Froehlich, Tom Hoffman and Mary Wels were present.  Others in attendance included Vanessa Drill and Michael Koob (<i>Ledger</i>). </p>
<p>The purpose of the hearing was to hear comments on the 2013 Budget and Tax Levy.  </p>
<p>With no public input, at 6:30 p.m. the public hearing was adjourned and the Council turned its attention to the business of the regular December3, 2012 meeting at this time Gary Johnson and Benjamin Matzke joined the meeting.<i> </i></p>
<p><i>The agenda was approved on a motion which was made F. Froehlich, which was seconded by T. Hoffman, and which carried with all voting in favor.</i><i> </i></p>
<p><i>The minutes of the November 19, 2012 regular meeting was approved on a motion which was made by S. Johnson, which was seconded by M. Wels, and which carried with all voting in favor.</i> </p>
<p><i>The bills totaling $117,311.33 were approved on a motion which was made by F. Froehlich, which was seconded by T. Hoffman and which carried with all voting in favor.</i> </p>
<p><i>Transfer of $92,000 from Money Market account to the Checking Account was approved on a motion made by S. Johnson, which was seconded by M. Wels, and which carried with all voting in favor.</i><i> </i></p>
<p>The Clerk notified the council that there is no conditional use permit for Patrick Kunerth on file.  It was noted that Kunerth is renting an apartment in a commercial zone, which a single and multi-family dwellings in not a permitted use.  Kunerth will need to obtain a conditional use permit.  The council instructed the clerk to send a certified letter to Kunerth stating he is out of compliance and will need to apply for the permit.</p>
<p>Gary Johnson noted that the maintenance department should have everything out of the ‘old maintenance’ building within a week or two. </p>
<p>Benjamin Matzke approached the council to discuss the city’s purchase of a portion of his property in order to widen 5<sup>th</sup> Street, which is part of the 2013 Street &amp; Utility Improvement Project.  Matzke’s said proposal placed a value on approximately 20’ x 183’ strip of land and miscellaneous trees and shrubs a value of $37,000.  Matzke stated his proposal is calculated as follows; $17,000 for the single stall garage, $17,000 for the land, $7,050 for mature trees and shrubs minus $4,000 for storm damage to his existing garage.  It was agreed that the exact square footage will need to be known in order to negotiate buying of the property.  Froehlich will work with Bolton and Menk to determine how much of the land is needed. </p>
<p>Steve Johnson shared a report from the Fire Relief meeting that he attended.<i> </i></p>
<p>The council set February 4 as the date to auction off the old maintenance building located at 205 Pine Street.  The auction will be held at City Hall at 6:30 p.m. </p>
<p>Froehlich noted that the Environmental Protection Agency (EPA) will be inspecting Nicollet businesses during the next few months.  The goal is to identify and work with out of conformance business in a cost effective manner to meet federal standards. </p>

<p><i>RESOLUTION  #12-03-12 – Adopting the Final 2013 Budget was approved on a motion which was made by F. Froehlich, which was seconded by T. Hoffman, and which carried with all voting in favor.  </i> </p>
<p><i>RESOLUTION #12-03-12A:  Adopting the Final 2013 Tax Levy with a total levy of $257,283 of which $63,000 = general funds and $194,283 = debt funds was approved on a motion which was made by S. Johnson, which was seconded by F. Froehlich, and which carried with all voting in favor.</i><i> </i></p>
<p><i>Change Order #7 for the City Hall maintenance addition in the amount of $669.02 was approved on a motion which was made by F. Froehlich, which was seconded by S. Johnson, and which carried with all voting in favor.</i></p>
<p><i>The contract between the City of St Peter and the City of Nicollet for contracting for building inspector services was extended for 1 year.  The contract was approved on a motion which was made by S. Johnson, which was seconded by M. Wels, and which carried with all voting in favor.</i></p>
<p><i> </i><i>The LG220 Application Permit for the American Legion’s annual fish fry for February 2, 2013 was approved on a motion which was made by F. Froehlich, which was seconded by M. Wels, and which carried with all voting in favor.</i><i> </i></p>
<p><i>An Abdo, Eick, and Meyers; Engagement Letter for 2012 Audit was approved on a motion which was made by M. Wels, which was seconded by T. Hoffman, and which carried with all voting in favor.</i> </p>

				<content:encoded><![CDATA[<p>Mayor Glenn Thompson called the regular November meeting of the Nicollet City Council to order at 6:30 p.m. on November 19, 2012, in the council chambers.  </p>
<p>In addition to Mayor Thompson; Council members Steve Johnson, Fred Froehlich, Tom Hoffman and Mary Wels were in attendance.  Others in attendance included Vanessa Drill, Gary Johnson, Joe Duncan (<em>City Engineer</em>), and Michael Koob (<em>Ledger</em>). </p>
<p><em>The agenda was approved on a motion which was made T. Hoffman, which was seconded by M Wels, and which carried with all voting in favor.</em></p>
<p><em>The minutes of the October 22, 2012 regular meeting, October 29, 2012, special meeting and November 13, 2012 special meeting was approved on a motion which was made by T. Hoffman, which was seconded by F. Froehlich, and which carried with all voting in favor.</em> </p>
<p><em>The bills totaling $308,333.92 were approved on a motion which was made by F. Froehlich, which was seconded by M. Wels and which carried with all voting in favor.</em></p>
<p><em>Transfer of $270,000 from Money Market account to the Checking Account was approved on a motion made by S. Johnson, which was seconded by T. Hoffman, and which carried with all voting in favor.</em><em> </em></p>
<p>The Clerk noted that come January 2013, there will be a vacant council seat, which will need to have someone appointed to fill the remaining term of Councilor Froehlich, as he was elected to the Mayor position starting in 2013. </p>
<p>The Maintenance Supervisor:<br />
1)  Supplied a water movement report<br />
2)  Noted that fireproof cabinets were needed for chemicals and paint in the new addition </p>
<p>Council directed the Clerk to accept the low bid for construction of a stairway for the storage area over the council chambers. </p>
<p>S. Johnson and F. Froehlich noted that they received complaints about the number of parking spaces the tenants of the apartment in the Chiropractic Building are taking up on 3<sup>rd</sup> Street.  Council directed the clerk to follow-up with the Conditional Use Permit that was granted for the apartment.</p>
<p>Joe Duncan (<em>City Engineer</em>) supplied an option matrix for the council per a discussion at the last council meeting as to what the assessment figures verses tax levy would be for a 50/50 possible change in the assessment policy for the 2013 Street &amp; Utility Improvements. </p>
<p>The Clerk shared from Northland Securities an estimated property tax impact summary for the 2013 Street &amp; Utility Improvements with an assumption of the assessment policy being changed to 50/50 Street with 50/50 Mainline Utilities. </p>
<p>The Council will wait until the December 3 meeting to make a plan on selling the Old Maintenance Building. </p>
<p>The first meeting of the New Year 2013 was set for January7, 2013 @ 6:30 p.m. <em>                                </em></p>

<p>In addition to Mayor Thompson; Council members Steve Johnson and Mary Wels were in attendance.  Councilmen; Fred Froehlich and Tom Hoffman were absent.  Others in attendance included Vanessa Drill. </p>
<p>The purpose of this special meeting was to canvass the 2012 general election results. </p>
<p>RESOLUTION 11-13-12: CANVAS GENERAL ELECTION RESULTS was approved on a motion which was made by M. Wels, which was seconded by S. Johnson, and which carried with all voting in favor.  Said resolution declares Fred Froehlich as the winner of the Mayoral race and Steve Johnson and Mary Wels as the winners of the City Council race.            <strong></strong></p>
<p>With no further business, the meeting was adjourned at 5:35 p.m.<br />
